Foreigners can receive American citizenship under specific conditions. The most common ways refer to the following:

•    The person has received a green card for Miami, U.S., for at least 5 years at the time when the holder applies for citizenship.
•    The holder of a green card is married with a U.S. citizen. The spouse visa in the USA can be obtained by foreigners who are married to American citizens. Both spouses need to meet specific requirements, however, the US national will act as sponsor, therefore, will be subject to additional conditions. Among these, showing sufficient income to support the foreign spouse (Form I-864, Affidavit of Support) once arrived in the United States. Based on this visa, the immigrant spouse can qualify for permanent residency later on.

Our lawyer can offer you advice related to the naturalization process for married persons, family citizenship, spouse visas, and residency applications, but also on applications related to political asylum or deportation defense.

What is naturalization?

The procedure by which an immigrant to the United States of America can become a citizen is known as naturalization. Only a select group of immigrants are qualified: those who have fulfilled specific military service requirements or who have held a green card (permanent residency) for three to five years. The majority of immigrants to the US go through the naturalization process and become citizens. Applying for citizenship is one of the most popular routes for Lawful Permanent Residents, or US green card holders, who fulfill the requirements. In fiscal year 2024, USCIS approved 818,500 naturalizations.

From the time you submit your citizenship application until you appear at the Oath of Allegiance ceremony, the duration varies by USCIS field office (check the current times on uscis.gov/processing-times).

US naturalization requirements

In order to obtain US citizenship through the naturalization procedure, you must meet the following requirements:

  • you must be at least 18 years of age when filing for naturalization;
  • during the 3 or 5-year waiting period, trips abroad of more than 6 months may break continuous residence (trips of 1 year or more break it), and you must have been physically present in the US for at least half of that period;
  • you must have spent at least 3 months living in the state where you intend to petition for citizenship;
  • for male citizens who were physically present in the country between the ages of 18 and 25, another requirement is to register with the Selective Service System.

Additionally, naturalization also implies having a good moral character, which is meeting expectations of the community in the city/town you live in. However, it also means you did not commit specific crimes, like murder, illicit gambling, or faking an offense to the American government in order to receive immigration advantages.

An English language test encompassing reading, writing, and speaking, as well as a civics test covering knowledge of American history and government, are also requirements for passing the naturalization process.

While the procedure may seem complicated, it is not in fact, as long as you have all documents in order and know the US Constitution. If you need assistance in drafting your papers, you can rely on our citizenship lawyer in the USA.

If you are new to the country and need support in filing for a US Green Card or even a spouse visa, you can rely on our lawyer who also specialize in other matters than citizenship by naturalization.

Naturalization process in Miami  in 2026

If you are interested in obtaining the USA citizenship in 2026, you should know that you must fulfill several requirements, as stated by the local legislation. In order to become a citizen of USA, you must have lived here for the last five years and make the proof that you have received the right to permanent residency on the American territory. If you are married to an American citizen and you apply for the citizenship, you must have lived in the USA for at least three years.

It is also compulsory to know the English language, the American Constitution and American history; when applying for citizenship in 2026, you must take an oath of allegiance. You also must make the proof that you are the owner of a Green Card.

The naturalization process starts by filing the Form N-400 (Application for Naturalization). As a general rule, the person should meet several criteria, as mentioned above, but it is important to know that the age is also relevant, as the applicant should have at least 18 years old.

The citizenship interview

The time until the citizenship interview varies by USCIS office (see uscis.gov/processing-times). A USCIS officer will check that all of the information on your naturalization application is accurate during this interview. The nearest USCIS office is often where the interview takes place. The interview generally takes place in the United States, not at a US embassy or consulate (except in limited cases such as certain members of the US armed forces and their families), even if you are applying from abroad.

The USCIS officer will also provide a two-part naturalization examination which will verify your oral and written English proficiency in the first part, under the form of English language test. The second exam, a civics test, will check your familiarity with American history and concepts of how the American government works. For applications filed on or after 20 October 2025, the 2025 civics test applies: the officer asks up to 20 questions from a list of 128, and 12 correct answers are needed to pass.

The USCIS official will approve your application following the interview if you pass the exam and interview. In some circumstances, USCIS may request more supporting evidence from you or arrange for a second interview.
